Car Rental Terms and Conditions

MNE Rentals and Tours is powered by Gorica Travel d.o.o., Herceg Novi, Montenegro. By renting a vehicle from us, the Client agrees to the following detailed terms and conditions.

1. Rental Terms – Basic Terms and Conditions

1.1 The Rental Company rents the specified vehicle to the Client for the period and under the conditions stated in the Rental Contract.

1.2 By signing the Rental Contract, the Client confirms that the vehicle was received in proper condition, clean, and with the fuel level specified in the Contract.

1.3 The Client is obliged to return the vehicle on the agreed date and time. If the Client wishes to extend the rental period, written approval from the Rental Company is required at least 24 hours before the agreed return time, along with an additional deposit. The Rental Company reserves the right to deny extension.

1.4 The Client is responsible for fuel used during the rental period and must return the vehicle with the same fuel level. Refueling charges apply if this condition is not met.

1.5 The Client must return the vehicle with all accessories, documents, and additional equipment provided at the time of rental. Missing or damaged items will be charged according to the official price list.

1.6 The vehicle may only be operated by the Client or an additional driver explicitly listed in the Rental Contract.

1.7 Prohibited uses of the vehicle include:
– Towing other vehicles;
– Participation in races or competitions;
– Driving under the influence of alcohol, narcotics, or medication that impairs driving ability;
– Transporting more passengers than permitted;
– Transporting animals, flammable or explosive materials, or items that may damage the interior;
– Driving off-road or on unclassified roads;
– Use by persons not listed in the Rental Contract as drivers.

1.8 Border crossing is only permitted with prior written approval of the Rental Company and purchase of the Cross-Border option.
Distances and fees are specified in the insurance and extras policy. Unauthorized border crossing is strictly forbidden and may result in penalties and loss of insurance coverage.

1.9 If the Client exceeds the agreed deadline for returning the vehicle without consent of the Rental Company, the vehicle will be considered misappropriated, and the Rental Company will notify the authorities.
The Client assumes full financial and legal responsibility in such cases.

1.10 During the rental period, the Client is obliged to maintain the technical safety of the vehicle, check coolant, oil, and tire pressure. Any repairs must be pre-approved by the Rental Company.
Costs will be refunded only upon presentation of receipts and prior approval.

1.11 The Client is responsible for all damages caused by improper use, negligence, or violation of traffic rules, including driving on unsuitable roads.
The Client will also cover towing expenses, loss of value, and loss of revenue for days when the vehicle is out of service.

1.12 The Client must safeguard the vehicle keys, registration documents, and license plates. In case of loss or damage, replacement costs are charged as follows:
– Registration permit: €100
– Vehicle keys: €450 to €1,800
– Green card: €40
– Registration plate: €100
These items are not covered by any insurance.

2. Insurance Policy

All vehicles are insured in accordance with Montenegrin law. Insurance packages are mandatory and must be selected at the time of booking.
A police report is required for any incident in order for insurance coverage to be valid. Driving under the influence of alcohol or drugs invalidates all insurance.

2.1 Basic Package (No additional insurance)

– Includes mandatory third-party liability insurance only.
– The Client is fully liable for theft or damage to the rented vehicle.
– High deposit applies, depending on the vehicle class (€600–€1,000).

2.2 Upgraded Package

– Includes CDW (Collision Damage Waiver) and TP (Theft Protection).
– Partial protection against damage and theft.
– Excludes: glass, tires, undercarriage, and interior.
– Reduced deposit compared to Basic (€300–€500).

2.3 Full Coverage Package

– Includes everything in the Upgraded package plus protection for glass, tires, undercarriage, and interior.
– Lowest deposit requirement (€150–€300).
– Provides maximum protection when a valid police report is provided.

Insurance validity requires that the Client:
– Reports all accidents immediately to the police and Rental Company;
– Provides official police documentation;
– Submits an alcohol/drug test report when required by law;
– Cooperates fully with authorities and the Rental Company.
Failure to comply results in full liability for damages.

3. Obligations of the Client

– Respect traffic laws and speed limits. Speeding may result in partial liability even with insurance (10%–50% of damage).
– Pay for all traffic violations, fines, and penalties incurred during the rental period, plus a €30 administrative fee per violation.
– Lock the vehicle when not in use and keep documents secure.
– Report any technical issue or accident immediately.
– Return the vehicle on the agreed date, time, and location. Failure to do so may result in charges or reporting to authorities.

4. Obligations of the Rental Company

– Deliver a technically safe, clean, and roadworthy vehicle.
– Provide support 24/7 during the rental period.
– Replace the vehicle in case of major breakdown within 6 hours in Montenegro or 24 hours abroad (excluding damages caused by Client negligence).
– Guarantee the agreed vehicle class or provide a vehicle of equal or higher class at no extra cost.

5. Payment & Deposit Policy

– Payment is made at pick-up (Pay at Pick-up). Valid credit/debit card required as guarantee.
– Deposit amount depends on selected insurance package and vehicle class.
– Deposit is refunded after vehicle inspection at drop-off, provided there is no damage, missing equipment, fines, or excessive cleaning required.
– If the Client fails to provide a valid card or sufficient deposit, the Rental Company may cancel the reservation.

6. Cancellation & Refund Policy

– Cancellations more than 24h before pick-up: full refund (excluding insurance fees).
– Cancellations within 24h: €50 + one rental day fee.
– Changes within 24h: €30 administrative fee.
– With Cancellation Fee (CF) insurance: changes and cancellations are free of charge.
– No-shows without notice: full rental amount is charged.

7. Privacy & GDPR

The Rental Company processes Client data strictly in accordance with GDPR and Montenegrin data protection laws.
Data is collected for booking, insurance, and rental purposes only, and is stored securely.
Data is never shared with third parties, except as required by law. Clients may request deletion of personal data after completing the rental.

8. Final Regulations

– These Terms are governed by Montenegrin law.
– In case of disputes, the competent court is in Herceg Novi, Montenegro.
– The English version of these Terms prevails over translations in case of discrepancies.
– Amendments are valid only in written form, signed by both parties.
